Clash of Laws: The Dissonance Between Title IX, the IDEA, and Section 504

  • Session Number: B1
Wednesday, April 21, 2021: 4:00 PM - 5:15 PM

Speaker(s)

Presenter
Rebecca Bailey
Partner
Thompson & Horton LLP

Description

Sweeping amendments to Title IX regulations sometimes clash with the IDEA and Section 504 procedural protections. For example, the regulations provide for the “emergency removal” of students who are deemed an “imminent threat" but do not consider the MDR requirements and other procedural safeguards where the removal constitutes a change of placement. Attorney Rebecca Bailey will prepare you to respond to Title IX compliance barriers and show you how to navigate investigations when students with disabilities are involved. Through case scenarios and hypotheticals, she will point out common pitfalls, poor practices, and things to avoid when students with disabilities are accused of sexual harassment. Take home a notebook of practical guidance for a legally defensible Title IX investigation.
