School districts must adopt a positive approach to confronting disability-related misconduct. Yet, the IDEA only provides vague outlines for what a functional behavioral assessment is, how it should be conducted, and by whom. Likewise, specific guidance on creating defensible or effective behavioral intervention plans is sparse in the statutory/regulatory text. COVID-19 has added to the challenge, as students continue to learn in remote and hybrid settings. Schools may thus struggle with understanding when FBAs/BIPs are required, what components make an effective FBA/BIP, who is qualified to conduct an FBA or prepare a BIP, and how to utilize the FBA and BIP tools to effectively address student misconduct in person and remotely. Attorney David Garner will give attendees the tools necessary to ensure compliance with IDEA requirements regarding FBAs and BIPs, as well as practical tips to conduct and implement each.
