Just because students are not learning at school during periods of virtual instruction does not mean behavior challenges stop. Educators have had to contend with student misconduct during virtual and hybrid instruction, and it is not always clear what behavior is subject to discipline or how to comply with the IDEA when students are not physically present. Former teacher turned school attorney Jeremy Neff will emphasize a practical approach to IDEA compliance during virtual and hybrid learning. He will review in detail IDEA’s requirements for discipline, including manifestation determination reviews, that continue to apply during COVID-19. This session will draw on recent case law to identify where schools sometimes run into trouble applying these long-standing requirements in the context of an unprecedented school year.
