Description

Opening specialized campuses or magnet programs, or providing the option of in-school or distance learning following school closures present interesting issues for students who are IDEA eligible. For example, what happens when the IEP team develops an IEP that requires a particular environment or complex services that cannot be provided in the choice program? Can 504/ADA equal access result in a unilateral choice by the student and parent requiring the school to serve the student in a program where special ed FAPE cannot be provided? David Richards will explain why IDEA students do not lose the antidiscrimination protections of the ADA/504 and share tips on how IEP teams can prepare for parents' school choice to a placement where FAPE cannot be provided.
