Courts often note that the parental participation safeguards of the IDEA are among the most important to protecting students' rights and fulfilling the purposes of the IDEA. Naturally, parental participation becomes a focal point in disputes between parents and schools, and there has been a rise in litigation regarding parental participation and alleged retaliation. Many of these disputes center around a district’s actions to curtail the communication with, or access to, school staff and facilities. In light of these recent cases, Attorney Bobby Truhe will explore the rights of parents to advocate, access facilities, and participate in their student’s education under the IDEA, Section 504, and the First Amendment.
